Terms and Conditions

These Terms and Conditions govern the relationship between GK Tool-Haus (Pty) Ltd (“the Company”, “we”, “our” or “us”) and any person or entity (“the Customer” or “you”) who accesses the website www.gktoolhaus.co.za (“the Website”) or purchases any products from the Company. By using the Website or purchasing products, the Customer agrees to be bound by these Terms.

 

  1. Company Information

GK Tool-Haus (Pty) Ltd is a private company duly registered in the Republic of South Africa. The registered address of the Company is 1 Mahogany Street, Northmead, Benoni, South Africa. The Company may be contacted at the following email address: Gerhard@gktoolhaus.co.za, and telephone number: +27 10 500 7766. The sole owner of the Company is Mr. Gerhard Lehmann.

 

  1. Products and Availability

The Company imports and supplies tools and consumables. The products offered on the Website are subject to availability, and the Company reserves the right to withdraw or amend any product without prior notice. The Company endeavours to provide accurate descriptions and images of products, but minor variations in packaging or design may occur, and such variations shall not constitute grounds for return.

 

  1. Pricing

All prices displayed on the Website are stated in South African Rand (ZAR). Prices include applicable taxes but exclude delivery charges unless specifically indicated otherwise. The Company reserves the right to amend prices at any time without prior notice. The price payable for any product is the price reflected at the time of finalising the order, subject to correction in the event of an obvious error.

 

 

  1. Orders and Payment

An order placed by a Customer constitutes an offer to purchase and shall only be deemed accepted once full payment has been received by the Company. Payment may be made by way of electronic funds transfer (EFT), debit or credit card via Yoco, or through BobPay. The Company does not accept payment on delivery. Upon receipt of payment, the Company shall issue an order confirmation via email to the Customer.

 

  1. Delivery and Collection

The Company offers nationwide delivery within the Republic of South Africa. Delivery costs shall be for the account of the Customer and will be specified at the time of order. The Customer is responsible for providing an accurate delivery address, and the risk of loss, damage, or theft passes to the Customer upon delivery of the product to such address. Customers may alternatively elect to collect their orders directly from the Company’s registered address, provided prior arrangement has been made.

 

  1. Returns and Refunds

Consumables purchased from the Company are sold without warranty and are non-returnable. Tools may only be returned in the event of a defect, which must be reported to the Company within seven (7) days of delivery. Returned tools must be unused, in their original packaging, and accompanied by valid proof of purchase. The costs of couriering returned products shall be borne by the Customer. Refunds will be processed once the Company has inspected the returned product and confirmed the defect.

 

  1. Warranties and Liability

The Company provides no warranties in respect of consumables. Tools are warranted only to the extent required by the Consumer Protection Act, 68 of 2008 (“the CPA”), and, where applicable, as provided by the manufacturer. The Company shall not be liable for any loss, damage, injury, or expense arising from the misuse, improper installation, or unauthorised modification of tools supplied. Furthermore, the Company shall not be liable for indirect or consequential damages, including loss of profits, business interruption, or loss of data. While the Company endeavours to ensure accuracy of information provided on the Website, it shall not be liable for typographical errors, stock discrepancies, or technical interruptions.

 

  1. Intellectual Property

All intellectual property appearing on the Website, including but not limited to trade names, trademarks, logos, product descriptions, photographs, and design elements, is the property of the Company or its licensors. No Customer may copy, reproduce, distribute, or otherwise exploit any such intellectual property without the prior written consent of the Company.

 

  1. Website Use

The Customer undertakes to use the Website lawfully and in compliance with these Terms. The Customer shall not engage in any conduct that may damage, disable, or impair the Website or interfere with any other party’s access to the Website. The Customer may not attempt to gain unauthorised access to the Website, its servers, or any associated databases. Any unlawful or prohibited use of the Website may result in suspension of access and possible legal action.

 

 

 

  1. Privacy and Protection of Personal Information

The Company respects the privacy of its Customers and undertakes to comply fully with the Protection of Personal Information Act, 4 of 2013 (“POPIA”).

10.1 Personal Information Collected: The Company may collect the Customer’s full name, contact details including email address, telephone number, and physical address, payment details (processed securely through Yoco or BobPay without storage of card details), and purchase history.

10.2 Purpose of Collection: Such personal information is collected strictly for the purpose of processing orders, arranging delivery or collection, handling returns, and maintaining business records. The Company may also, with the Customer’s consent, use such information to communicate promotional material or updates relating to its products.

10.3 Storage and Protection: The Company takes all reasonable measures to safeguard personal information against loss, unauthorised access, disclosure, alteration, or destruction. Information is stored on secure systems, and payment transactions are processed by third-party service providers using encryption and secure platforms.

10.4 Disclosure: The Company shall not sell or distribute personal information to third parties, except where disclosure is required by law or necessary for the fulfilment of an order (for example, to a courier company).

10.5 Customer Rights: The Customer has the right to request access to, correction of, or deletion of their personal information held by the Company. Such requests may be submitted in writing to Gerhard@gktoolhaus.co.za.

 

  1. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or any purchase from the Company shall, in the first instance, be resolved amicably between the parties. Should resolution not be possible, the dispute shall fall within the exclusive jurisdiction of the courts of South Africa.

 

  1. Amendments

The Company reserves the right to amend these Terms at any time without prior notice. The amended Terms shall be published on the Website and shall take effect from the date of publication. Continued use of the Website after any amendments constitutes acceptance of the amended Terms.
